Claims Policy

We are committed to providing you with photographs of the highest quality. However, if you receive a damaged work, you may file a claim with us, which we will review. Please read our terms and conditions below carefully. A claim can be made if the photographs are received damaged and if the packaging of the work is intact upon receipt.

 

 

 

Claims procedure.

 

If you notice any damage, please follow the procedure below:

 

1. Take photos: Take clear, visible photos of the damage. The photos must include: - A full photo of the artwork. - A photo of the damage (detail showing the damage). - A photo of your delivery note, where the delivery date is clearly visible.

 

2. Notification period: All photos must be taken and sent within 24 hours of receiving the order.

 

3. Send the photos: Send the photos by email to the following address: christophefoucault971@gmail.com. Be sure to include: - Your full name. - Your order number. - A brief description of the damage.

Claims processing.

 

We will review your request and the photos provided. If your request is approved, we will reprint the work within 14 days of approval. We will cover the shipping costs.

 

 

 

Limitations

 

- Claims will not be accepted after 24 hours of receiving your order. - Incomplete requests or those without the required visual evidence will not be processed. Policy Changes We reserve the right to modify these claim conditions at any time. Any changes will be posted on this page with a new effective date. We encourage you to check this page regularly to stay informed of any changes.

Special terms and conditions of sale

These special terms and conditions (hereinafter referred to as “STC”) supplement and clarify the General Terms and Conditions of Sale (GTC) of the website [christophefoucault.fr/christophefoucault.com]. In the event of any contradiction between the GTC and the STC, the STC shall prevail for purchases of digital items (image downloads).

 

1. Purpose

 

These SPT govern the sale and use of digital items, consisting of images (photographs, illustrations, etc.) offered for download on the Website (hereinafter referred to as “Images”).

 

2. License of Use

 

The purchase of an Image gives the Customer a non-exclusive and non-transferable right of use, in accordance with the license chosen at the time of purchase (Personal License or Professional License, as defined in the Site's Digital Photo Sales Policy).

 

3. Restrictions on Use – Prohibition on Resale

 

3.1. Prohibition on Resale: The Customer expressly agrees not to resell, distribute, share, offer, transfer, or sublicense the Images, whether in digital or printed format, in any manner whatsoever.

 

3.2. Authorized Use: Use of the Images is strictly limited to the use defined by the license acquired (Personal or Professional) and to the conditions specified in the Site's Digital Photo Sales Policy. Any non-compliant use will result in the immediate revocation of the license and may give rise to legal proceedings.

 

3.3. Modification: The Customer may modify the Images within the scope of the use authorized by their license, provided that such modifications do not distort the original work and respect the moral rights of the author.

 

4. Price and Payment

 

4.1. Price: The price of each Image is indicated on the Image description page on the Website, in US dollars and including all taxes.

 

4.2. Payment: Payment is made online, using the payment methods offered on the Website. The order will only be confirmed after receipt of full payment.

 

5. Delivery

 

Once payment has been validated, the Customer will receive a download link for the Image, in the format chosen when placing the order. The Customer is responsible for saving the downloaded Image. The Seller shall not be held liable for the loss of the Image after download.

 

6. Right of Withdrawal

 

In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for digital content provided on an intangible medium whose performance has begun after the consumer's prior express agreement and express waiver of their right of withdrawal. Consequently, the purchase of Images is final and definitive and cannot give rise to any refund.

 

7. Warranty

The Seller guarantees that the Images comply with their description on the Website and that they are free of any third-party rights that could prevent their use under the terms defined by the license acquired.

 

8. Liability

 

The Seller's liability is limited to the purchase price of the Image. The Seller shall not be liable for any indirect damages, such as loss of profits, loss of data, or any other financial loss resulting from the use of the Images.

 

9. Applicable Law and Competent Jurisdiction

 

These CPV are governed by French law. Any dispute relating to their interpretation or execution shall be subject to the exclusive jurisdiction of the courts of Pointe-à-Pitre, Guadeloupe, FRANCE.

Dans le cadre de notre engagement pour soutenir les jeunes artistes, nous prélèverons 5 % du montant total de chaque vente au profit de l'association Corpo Art l’Art d’Aider. Ces fonds seront utilisés pour aider les jeunes artistes à se lancer, en finançant des ateliers, des expositions et d'autres initiatives. ### Confirmation de paiement Après avoir soumis votre commande, vous recevrez un e-mail de confirmation détaillant votre achat et les informations de paiement.
